HB 294/Analysis (BR 1138) - H. Moberly

     AN ACT making appropriations for the operations, maintenance, support, and functioning of the judicial branch of the government of the Commonwealth and its various officers, boards, commissions, subdivisions, and other state-supported activities.
     The Judicial Branch Budget: appropriate in the Court of Justice moneys from the general fund, restricted funds, and federal funds totaling $214,647,400 in fiscal year 2002-2003 and $226,318,800 in fiscal year 2003-2004; provide a 2.7% salary adjustment in fiscal year 2002-2003 and fiscal year 2003-2004 for nonelected court personnel and justices and judges; include funds for the salaries of circuit clerks in fiscal year 2002-2003 and fiscal year 2003-2004 as recommended in the judicial branch budget recommendation; provide for the 2001 actuarial assessed need for the Judicial Form Retirement System; include language relating to the Kentucky Legal Education Opportunities (KLEO) Program; and provide that funding for previously authorized court facilities shall not be reduced.

HB 294 - AMENDMENTS


     HCS - Retain original provisions of the bill with the following changes: decrease General Fund appropriation for fiscal year 2002-2003 by $3,861,600; specify that funds are provided in fiscal year 2003-2004 for a cost-of-living adjustment amounting to an annualized value of $1,080 for nonelected permanent full-time court personnel, justices and judges, and circuit clerks and deputy circuit clerks, and a pro rata equivalent for permanent part-time employees; require that both phases of the Kentucky Legal Education Opportunities (KLEO) Program be operational for fiscal year 2003-2004; require that $6,000,000 from the General Fund carried forward from fiscal year 2001-2002 into 2002-2003 in the Local Facilities Fund lapse to the General Fund Surplus Account within 30 days of the effective date of the Act; and state the intent of the General Assembly that the Court of Justice not eliminate or reduce the number of District Court or Circuit Court employees below the level employed on January 1, 2003.

     HFA (1, S. Riggs) - Decrease appropriation for court operations and administration in fiscal year 2003-2004 by $1,370,000.

     HFA (2, R. Damron) - Raise the jurisdictional limit of the Small Claims Division of District Court from $1,500 to $1,800.

     HFA (3, J. Crenshaw) - Allow the Chief Justice to transfer funds between budget units.

     HFA (4, H. Moberly) - Insert language to clarify that a 2.7% cost-of-living salary adjustment is provided for fiscal year 2002-2003.

     SCA (1/Analysis, R. Sanders Jr) - Require the Judicial Branch to submit annual reports to the Interim Joint Committee on Appropriations and Revenue regarding arrest fees assessed and remitted to each law enforcement agency and the amount and nature of uncollected court fees.
