HB 355 (BR 1398) - J. Vincent
AN ACT relating to the protection of children placed in out-of-home care.
Amend KRS 199.462 to require a fingerprint check with the Department of State Police and the Federal Bureau of Investigation before any applicant is approved as an adoptive home or to provide foster care, relative caregiver services, or kinship care services; require fingerprint checks annually for certified adoptive and foster homes; and authorize promulgation of an administrative regulation to carry out these requirements.
HB 355 - AMENDMENTS
HCS - Retain original provisions, but allow the fingerprinting to be requested from either the Department of State Police or the Federal Bureau of Investigation, or both.
HFA (1, J. Vincent) - Retain original provisions except require the cabinet to obtain a criminal background by a fingerprint check by the Department of State Police and the Federal Bureau of Investigation or by conviction information from the Kentucky Justice Cabinet and require similar procedures for reevaluation of foster or adoptive homes.
HFA (2, J. Vincent) - Retain original provisions except require the cabinet to obtain a criminal background by a fingerprint check by the Department of State Police and the Federal Bureau of Investigation or by conviction information from the Kentucky Justice Cabinet; require background checks for the applicant's adult household members; require similar procedures for reevaluation of foster or adoptive homes.
SCS - Retain original provisions and add a section amending KRS 199.520 to permit the Cabinet for Families and Children to provide nonidentifying background information about biological parents to adoptive parents; add a section to amend KRS 337.010 to exempt persons providing adult foster care from the definition of "employee" for wage and hour requirements.
