HB 369 (BR 1100) - B. Crall, J. Gooch
AN ACT relating to state risk.
Amend KRS 44.055, relating to the purchase of a blanket liability insurance policy covering state officers and employees, to delete the policy limit of $200,000 for state motor vehicle insurance policies; amend KRS 56.080, 56.090, 56.100, 56.120, 56.130, 56.140, 56.150 and 56.160 to change the term "public buildings" to "all real property," to increase the maximum valuation on any one subject of risk from $500,000 to $1,000,000, to provide for 100%, rather than 90%, valuation of state property for insurance purposes, and to require that the state fire and tornado insurance fund be invested in compliance with KRS 42.500; amend KRS 56.170 to require the Department of Insurance to make recommendations to a state agency regarding any hazard detected in the building occupied by the agency, rather than requiring the Department to conduct annual inspections for fire hazards; amend KRS 304.44-010, 304.44-030 and 304.44-050, relating to the mine subsidence insurance fund, to distinguish between dwelling and nondwelling structures for insurance purposes, and to cap the maximum insured value of a nondwelling structure at $200,000.
HB 369 - AMENDMENTS
SFA (1, D. Boswell) - Amend KRS 132.820 to separate unmined coal, oil and gas reserves as a group from the other mineral or energy resources in order to determine the amount owned by the surface owner for purposes of assessing the unmined mineral tax; clarify that the surface owner is not engaged in the severance, extraction, processing, or leasing of mineral or other energy resources as a permit holder or as an affiliate of a person that engages in those activities as a permit holder; include lessee or tenant among the persons that are using the surface primarily for agricultural activities; and renumber subsequent sections accordingly.
