     AN ACT relating to the marketing of home-processed foods.
     Amend various sections of KRS Chapter 217 to exempt home-based processors from being required to apply for a permit to operate; require the Cabinet for Health Services to promulgate administrative regulations to accommodate the specific circumstances of home-based microprocessors; require the Kentucky Cooperative Extension Service to establish, implement, and administer a pilot microprocessing program pursuant to 21 C.F.R. sec. 114.10.

HB 391 - AMENDMENTS


     HCA (1, C. Hoffman) - Delete provision allowing food service establishments, retail food establishments, or retail food stores to offer home-based processed food products for sale but allow farmers markets, certified roadside stands, or a processor's farming operation to sell home-based processed food products.

     HFA (1, C. Hoffman) - Define "farmer"; allow cabinet to invoke cessation of production if there is reason to believe that an imminent health hazard exists; delete the allowance of food service establishments, retail food establishments, or retail food stores to offer home-based microprocessed food products for sale but allow farmers' markets, certified roadside stands, or a processor's farming operation to sell home-based microprocessed food products; delete the allowance of the Kentucky Cooperative Extension Service to evaluate and certify training for the pilot microprocessing program but allow the cabinet to do so; delete the allowance of the Kentucky Cooperative Extension Service to establish certification and recertification fees, terms, conditions, and length of time the certification is valid but allow the cabinet to do so; delete the requirement that one copy of the certification document be kept on file for public record but require the cabinet to receive one copy of the certification document; require the cabinet and the Kentucky Cooperative Extension Service to develop the examination document and criteria for program completion and establish the examination subject matter and program fees; change the deadlines for establishing and implementing the pilot microprocessing program; and change the deadlines for developing the required documents, processes and procedures for certification and examination.

     SCA (1, E. Harris) - Retain original provisions; make a technical correction to clarify the definition of "farmer" by requiring that the farmer has grown the primary horticultural and agronomic ingredients used in the products they have processed.
