HB 426 (BR 1401) - S. Nunn

     AN ACT relating to election fraud and declaring an emergency.
     Amend KRS 15.243 to require the county boards of elections to report to the State Board of Elections when 5% or more of the county's registered voters request absentee ballots, require State Board of Elections to notify the State Police and Attorney General's office of any such reports and request an investigation of suspected absentee ballot fraud, require the Attorney General to investigate suspected absentee ballot fraud and notify the State Board of Elections of the results of the investigation, require the Attorney General to prosecute any person within the Commonwealth for a violation of KRS 119.205 discovered during an investigation of the Attorney General and provide that action shall be brought in Franklin Circuit Court; amend KRS 117.085 to exempt requests for absentee ballot applications and absentee ballot applications from open records requirements until the voted ballot is returned to the county clerk; EMERGENCY.

HB 426 - AMENDMENTS


     HCS - Create new section of KRS Chapter 452 to provide that venue for criminal actions arising from violations of KRS Chapter 119 shall be in the county in which the offense is committed; create new section of KRS Chapter 117 to require the county boards of elections to report to the State Board of Elections when 5% or more of the county's registered voters request absentee ballots, except for absentee ballots under KRS 117.075, and require State Board of Elections to notify Attorney General's office of any such reports and request an investigation of use of absentee ballots; require the Attorney General to investigate use of absentee ballots and notify the State Board of Elections of the results of the investigation; amend KRS 15.243 to permit State Board of Elections to request inquiries of 3 additional counties for election irregularities; amend KRS 117.085 to prevent disclosure of absentee ballot requests and applications to any person other than the county clerk or deputies and exempt requests from open records requirements until after all voted ballots are returned to the county clerk or election day, whichever is earliest; remove emergency clause.
