HB 459 (BR 1523) - J. Jenkins, J. Vincent

     AN ACT relating to health care practitioners.
     Amend KRS 217.005(35) to add medical professionals licensed in another state to the definition of "practitioner"; amend KRS 217.814 to define "practitioner" as the same as KRS 217.005(35); amend 218A.010 to include medical professionals licensed and who have prescriptive authority for controlled substances under the laws of another state in the definition of "practitioner"; amend KRS 315.121 to include failing to exercise due diligence in determining whether a prescription is lawful as unprofessional or unethical conduct by a pharmacist.

HB 459 - AMENDMENTS


     HCA (1, D. Butler) - Retain the original provisions and require active practice in another state without revoked, suspended, restricted or probated license.

     HFA (1, J. Jenkins) - Change standard by which one's failure to determine whether a drug is unlawful constitutes unprofessional conduct from due diligence to appropriate professional judgment.
