HB 481/CI (BR 239) - J. Richards, B. DeWeese
AN ACT relating to regulation of athletic agents.
Repeal, reenact, and create various sections of KRS Chapter 164 to adopt the Uniform Athletic Agent Act; define terms; assign responsibility for registering athlete agents to Division of Occupations and Professions; allow division to promulgate administrative regulations needed to carry out the provisions of the Uniform Act; require all athlete agents to obtain certificate of registration from the division and to pay an annual fee not to exceed $300; allow seven days after contact with student-athlete for athlete agent to apply for certificate of registration; allow division to accept application and certification of person from another state with qualifications that meet or exceed those in this state; deny registration to any person convicted of relevant crimes or any person who has had registration, certification, or licensure denied or revoked by another state; list prohibited acts; require athlete agents to use approved contracts with specified disclaimers; require athlete agent to notify school of any contract entered into by a student-athlete; grant a student athlete 14 days within which to rescind a contract; require a student-athlete to notify the school within 72 hours of negotiating or signing a contract; require athlete agent to retain certain records for five years; make the athlete agent and the student-athlete liable for any damages a school incurs when a school is sanctioned as a result of the ineligibility of the student-athlete; direct the division to investigate complaints and take appropriate disciplinary action with the type of action to be based on the nature, severity, and frequency of the offense; provide for appeal of actions and a hearing under KRS Chapter 13B; establish criminal penalties for violation of certain provisions.

HCS/CI - Retain original provisions of bill except make technical change in heading of Section 14 to include language to amend KRS 164.689 as well as repeal and reenact as a new section of KRS Chapter 164.
