HB 92/FN (BR 114) - P. Bather

     AN ACT relating to an electronic health network to simplify administrative transactions.
     Create new sections of KRS Chapter 11 to define terms; create the Kentucky e-Health Network Board to oversee the development, implementation, and operation of a statewide electronic network of health care providers and insurers for the purpose of simplifying administrative transactions; establish the membership of the board; establish the responsibilities of the board; require any transactions by the network to comply with the federal Health Insurance Portability and Accountability Act; require the board to adopt standards for computer systems communicating with the central part of the network; authorize the board to promulgate administrative regulations; require an annual report to the Governor, Cabinet for Health Services, Office for the New Economy, Interim Joint Committee on Health and Welfare, and the Interim Joint Committee on Banking and Insurance; establish a "Ke-HN fund"; and amend KRS 45A.605 to authorize the use of the information highway for transactions and activities associated with the network, but not limit the board to using the information highway for all its communication services.

HB 92 - AMENDMENTS


     HCS/FN - Retain original provisions except create the Kentucky e-Health Network Board as an independent board instead of attaching it to the Governor's Office of Technology; delete the commissioner of the Department for Medicaid Services from membership on the board; delete the requirement that the Medicaid information system be connected to the Kentucky e-Health Network (Ke-HN); delete the requirement that the board facilitate the development of private and public partnerships in building the network; delete the provision to permit the network to use any Medicaid information system to support the transactions of the network; delete language requiring the board to receive and dispense funds appropriated by the General Assembly; delete state appropriations from the types of funds that may be received by the Ke-HN fund; add language to clarify that the Cabinet for Health Services shall not be required to participate in the network; and prohibit the use of state appropriations for the board or any of its functions.
