AN ACT relating to automobile insurance.
Amend KRS 304.20-040 to delete provision that prohibits an automobile insurer from declining, refusing to renew, or canceling a policy solely on the basis of the lack of a credit history of the applicant or insured; provide that if there is an absence of a credit history of the applicant or insured, the automobile insurer shall exclude the use of credit history as a factor in a decision to decline, refuse to renew, or cancel a policy.
HB 94 - AMENDMENTS
HCS - Delete original provisions of the Act; amend KRS 304.20-040 to provide that if an applicant or insured is 65 years of age or older and lacks a credit history, an insurer must exclude the use of credit history as a factor in determining rates or in a decision to decline, refuse to renew, or cancel a policy of automobile insurance.
