SB 1 (BR 448) - D. Williams, R. Roeding, C. Borders, J. Denton, E. Harris, A. Kerr, V. McGaha, V. Moore, K. Stine, G. Tapp, D. Thayer, E. Tori, J. Westwood

     AN ACT proposing amendments to the Constitution of Kentucky relating to health care matters.
     Propose amending the Constitution of Kentucky to add a new section permitting the General Assembly to limit noneconomic damages, limit punitive damages, provide statute of limitations on actions, and require alternative dispute resolution in cases involving health care providers licensed or certified by the Commonwealth; amend Section 14 relating to access to the courts, 54 relating to prohibiting limits on damages, and 241 relating to the right to sue in death and injury cases, to conform; provide for submission to the voters in the normal manner.

SB 1 - AMENDMENTS


     SCS - Make a technical correction which retains language proposing to amend the Constitution of Kentucky to add a new section permitting the General Assembly to limit noneconomic damages, limit punitive damages, provide statute of limitations on actions, and require alternative dispute resolution in cases involving health care providers licensed or certified by the Commonwealth; amend Sections 14 and 54 relating to access to the courts, Section 54 relating to prohibiting limits on damages, and Section 241 relating to the right to sue in death and injury cases, to conform; provide for submission to the voters in the normal manner.

     SFA (2, D. Mongiardo) - Amend to define "charitable health care provider"; permit General Assembly to provide civil immunity for charitable health care provider.

     SFA (3, D. Mongiardo) - Amend to define "charitable health care provider"; permit General Assembly to provide civil immunity for charitable health care provider.

     SFA (4, D. Mongiardo) - Amend to define "charitable health care provider," permit General Assembly to provide civil immunity for charitable health care provider, and permit General Assembly to provide civil immunity for pharmaceutical manufacturer who transfers legend drug to a charitable health care provider free of charge.

     SFA (5, D. Mongiardo) - Amend to define "charitable health care provider"; permit General Assembly to provide civil immunity for charitable health care provider, and permit General Assembly to provide civil immunity for pharmaceutical manufacturer who transfers legend drug to a charitable health care provider free of charge.
