SB 11 (BR 264) - D. Seum

     AN ACT relating to vehicle emission testing.
     Create a new section of KRS Chapter 77 to prohibit enforcement of a vehicle emission testing program by an air pollution control district board that is required to end the program.

SB 11 - AMENDMENTS


     SCS - Delete the original provisions; amend KRS 77.320 to specify that onboard diagnostic (OBD) system checks are part of a VET program; amend 186.290 to direct that after October 31, 2003 the Division of Vehicle Regulation may no longer refuse to register motor vehicles whose owners do not have a vehicle emissions compliance certificate and that registrations that had been revoked shall be reinstated.

     SFA (1, D. Seum) - Require a motor vehicle owner whose vehicle registration is revoked after October 31, 2003 as a result of failing to have the vehicle's emission system tested to pay a $22 vehicle registration reinstatement fee; direct that $13 shall be paid to the emission test system operator, $2 shall be retained by the county clerk, and $7 shall reimburse the county general fund for past damage claims paid to the emission test system operator.

     HFA (1, P. Clark) - Distribute twenty dollars of the reinstatement fee, rather than thirteen, to the local air pollution control district; delete the seven dollars allocated to the general fund of the consolidated local government.

     HFA (2/P, T. Burch) - Attach the provisions of HB 292.

     HFA (3/Title, T. Burch) - Make title amendment.
