SB 162/FN (BR 1447) - E. Worley, R. Jones II

     AN ACT relating to chemical weapons materials disposal.
     Amend KRS 224.50-130 to provide that no permit to treat or destroy a live chemical agent be granted as a research, development, or demonstration project except for a pilot scale operation; provide that permits only be issued if the application includes documentation from the host county that infrastructure requirements in the emergency plan will be provided and funding is provided for costs of a community liaison for community relations, emergency planning, community oversight of construction, operation, closure and emergency response of the facility.

SB 162 - AMENDMENTS


     SFA (1, E. Worley) - Replace the word "project" with "permit" in subsection (6) to clarify that the approval being required is for the permit for a pilot scale operation project, not the project itself; amend subsection (7) to clarify that the process of permit review may begin prior to approval of the permit.

     SFA (2, E. Worley) - Delete the provision that host county must approve of emergency response in order for cabinet to approve of permit or authorization; replace with provision that the requirements of the emergency response plan must be certified by the federal government and that host county must be provided with an opportunity to object to the certification.
