SB 17 (BR 478) - L. Casebier

     AN ACT relating to reorganization.
     Amend KRS 164.740 to make technical corrections to the definitions of the Kentucky Higher Education Assistance Authority; amend KRS 164.785 to permit that a Kentucky independent college or university may be accredited by a regional accrediting association recognized by the United States Department of Education rather than one (1) specific association; amend KRS 164.753 to delete specific requirements regarding the total amount of insured student loans that may be guaranteed by the authority; amend KRS 164.7891, the Osteopathic Medicine Scholarship Program, to make recipients liable for the total repayment of the sum of all outstanding promissory notes and accrued interest; provide that all moneys repaid to the authority under the Osteopathic Medicine Scholarship Program be added to the appropriations and provide that unobligated appropriations shall not lapse; amend KRS 164A.350, the Kentucky Educational Savings Plan Trust, to make permissive rather than mandatory certain penalties on the participant's account; amend KRS 164.746 to make changes to the membership of the Kentucky Higher Education Assistance Authority; amend KRS 164A.050 to make changes to the membership of the Kentucky Higher Education Student Loan Corporation; amend KRS 164A.370, 164.748, and 164.7874 to conform; confirm Executive Orders 2002-849 and 2002-848; repeal KRS 164.7893.

SB 17 - AMENDMENTS


     SCS - Retain original provisions; amend KRS 164.740 to include in the definitions students who graduate at the end of the first semester; amend definition of "regional accrediting association" to include additional organizations.

     SFA (2/Title, L. Casebier) - Make title amendment.

     HFA (1, J. Comer) - Retain original language; amend KRS Chapter 164 to permit the establishment of a scholarship fund in the name of a deceased student who had earned awards under the Kentucky educational excellence scholarship program.

     HFA (2/Title, J. Comer) - Make title amendment.

     HFA (3, R. Nelson) - Retain provisions of the original bill and amend various statutes of KRS Chapter 161 to transfer the Education Professional Standards Board to the Department of Education; amend KRS 161.017 to require the executive director to recommend actions and seek approval of the commissioner of education and require the commissioner to appoint the executive director recommended by the board; amend KRS 161.028 to delete the provision designating the board as a public corporate body; require the board to recommend the appointment of an executive director and consultants, and contracts for approval of the commissioner; amend KRS 161.126 appointing the commissioner of education as the "designated state official" authorized to enter into contracts pursuant to the Interstate Agreement on Qualification of Educational Personnel; amend KRS 12.020 and 12.023 to move the board to the Department of Education and detach the board from the Office of the Governor; and provide that savings from the transfer shall be reallocated to school districts for salary increases for classified employees.

     HFA (4, J. Comer) - Retain provisions of the original bill; and amend KRS Chapter 164 to permit the establishment of a scholarship fund in the name of a deceased student who had an earned award under the Kentucky educational excellence scholarship program and require the Kentucky Higher Education Assistance Authority to disburse awards to a participating institution on behalf of the student awarded the scholarship; provision shall apply retroactively to July 1, 2001.
