SB 23 (BR 254) - J. Westwood

     AN ACT relating to special license plates.
     Create new sections of KRS Chapter 186 to create a special CHOOSE LIFE license plate; establish minimum number of 900 applications and establish $53 fee for original registration and $25 for renewal; direct that proceeds for additional fees go into the "Choose Life program fund"; establish the "Choose Life program fund," set forth the purpose of the fund and requirements for recipients of fund money; EFFECTIVE July 1, 2003.

SB 23 - AMENDMENTS


     SFA (1, E. Scorsone) - Retain the provisions of the original bill without change and add two new sections to create a Protect Choice special license plate; require a minimum number of 900 applications be received with a $50 state fee before the Transportation Cabinet is required to print the special plate; provide that all plates printed in excess of 900 shall cost $53 to be divided as follows: $12 to the Transportation Cabinet, $3 to the County Clerk, and $38 to nongovernmental, nonprofit organizations that provide family planning or reproductive health services; prohibit money from a Protect Choice license plate to be sent to any agency or organization that prohibits or limits access to abortion services; require money generated from the sale of Protect Choice plates to be divided equally among all qualified agencies applying for funds under this Act; require qualified agencies to submit an annual audit to the Transportation Cabinet to verify funds were used appropriately; require qualified agencies seeking funds to submit to the Transportation Cabinet a declaration that an agency will comply with all financial requirements and restrictions established in the Act and identification information to help the cabinet distribute funds to agencies; renumber Section 3 as Section 5.

     HCS/LM - Retain the provisions of the original bill with the following changes: provide that if 900 requests for the plate are not received by the Transportation Cabinet within one year the provisions establishing a Choose Life license plate are automatically repealed; require once the 900 minimum threshold has been achieved the cost for all future Choose Life license plates shall be $15 which is the same fee charged for a regular license plate; provide that persons may make an additional voluntary contribution of $20 that a county clerk will forward quarterly to the Kentucky Foster/Adoptive Care Association, Inc.; require the Association to use money generated from the sale of Choose Life license plates for qualified agencies that promote counseling for pregnant women about the option of adoption; delete references to establishing a Choose Life program fund within the state Road Fund.

     HFA (1, F. Rasche) - Add provisions to create a special Support Education license plate, require 900 applications at a cost of $50 before the plate is designed and printed, provide that if 900 requests for the plate are not received by the Transportation Cabinet within one year the provisions establishing a Support Education license plate are automatically repealed; require once the 900 minimum threshold has been achieved the cost for all future Support Education license plates shall be $15 which is the same fee charged for a regular license plate; provide that persons may make an additional voluntary contribution of $20 that a county clerk will forward quarterly to the Kentucky Department of Education; require the department to use money generated from the sale of Support Education license plates for public elementary and secondary education; make effective July 1, 2003.

     HFA (2, K. Stein) - Add provisions to create a special Protect Choice license plate, require 900 applications at a cost of $50 before the plate is designed and printed, provide that if 900 requests for the plate are not received by the Transportation Cabinet within one year the provisions establishing a Protect Choice license plate are automatically repealed; require once the 900 minimum threshold has been achieved the cost for all future Protect Choice license plates shall be $15 which is the same fee charged for a regular license plate; provide that persons may make an additional voluntary contribution of $20 that a county clerk will forward quarterly to the Kentucky Association of Planned Parenthood Affiliates; require the Association to use money generated from the sale of Protect Choice license plates for qualified agencies that provide family planning or reproductive health services; set forth requirements for agencies receiving funds; make effective 7/1/03.

     HFA (3, M. Marzian) - Retain original provisions except delete all references to a voluntary fund and delete Section 2; change "Choose Life" to "Choose Senior Prescription Drug Medicare Benefit" and specify that a "Choose Senior Prescription Drug Medicare Benefit" license plate bear the likeness of the symbol of prescription drugs as "Rx".

     HFA (4, M. Marzian) - Retain original provisions except delete all references to a voluntary fund and delete Section 2; change "Choose Life" to "Choose An Increase in the Cigarette Tax Instead of Cuts to Human Services" and specify that a "Choose An Increase in the Cigarette Tax Instead of Cuts to Human Services" license plate bear the likeness of a wheelchair.

     HFA (5, M. Marzian) - Retain original provisions except delete all references to a voluntary fund and delete Section 2; change "Choose Life" to "Choose Gambling" and specify that a "Choose Gambling" license plate bear the likeness of a slot machine.

     HFA (6, M. Marzian) - Retain original provisions except delete all references to a voluntary fund and delete Section 2; change "Choose Life" to "Peace is Patriotic" and specify that a "Peace is Patriotic" license plate bear the likeness of a dove.

     HFA (7, M. Marzian) - Retain original provisions except delete all references to a voluntary fund and delete Section 2; change "Choose Life" to "Choose Pre-Emptive First Strike Doctrine" and specify that a "Choose Pre-Emptive First Strike Doctrine" license plate bear the likeness of a cruise missile.

     HFA (8, M. Marzian) - Retain original provisions except delete all references to a voluntary fund and delete Section 2; change "Choose Life" to "Choose No Death Penalty" and specify that a "Choose No Death Penalty" license plate bear the likeness of an electric chair with a red circle and red "X" superimposed on the electric chair.

     HFA (9, M. Marzian) - Retain original provisions except delete all references to a voluntary fund and delete Section 2; change "Choose Life" to "Choose Corruption by Special Interest Money" and specify that a "Choose Corruption by Special Interest Money" license plate bear the likeness of a dollar sign superimposed on the Capitol Dome.

     HFA (10/P, T. Burch) - Attach the provisions of HB 292.
