SB 64 (BR 867) - E. Harris

     AN ACT relating to statutory definitions regarding utilities.
     Amend KRS 278.010 to exclude sewer systems run by counties pursuant to KRS Chapter 67 from Public Service Commission control.

SB 64 - AMENDMENTS


     SFA (1, E. Harris) - Amend the definition of utilities in KRS 278.010 to remove sanitation districts from the jurisdiction of the Public Service Commission.

     HCS - Retain original language; exempt a county water district, created in accordance with KRS 74.010, undertaking a water line extension or improvement project with total project costs of no more than five hundred thousand dollars ($500,000) and with no rate increase to its customers due to the project from the definition of a public utility; amend KRS 224.40-315 to provide that utilities which generate electricity using refuse-derived fuel fall within the definition of a municipal solid waste disposal facility.

     HFA (1, R. Damron) - Exempt county water district water line extension or improvement project from definition of a "utility" for purposes of PSC review if the project costs less than $500,000 and the project does not result in a rate increase to customers.

     HFA (2/Title, D. Pasley) - Make title amendment.

     HFA (3/P, D. Pasley) - Amend KRS 224.40-315 to provide that utilities that generate electricity using refuse-derived fuel fall within the definition of a municipal solid waste disposal facility.

     HFA (4, S. Riggs) - Make technical correction.
