SB 70 (BR 130) - R. Roeding

     AN ACT relating to government contracts.
     Create new sections of KRS Chapter 45A and amend several sections of Chapter 45A to provide for legislative intent; exempt Memoranda of Agreement (MOA's) between state agencies and universities or colleges from routine review, but require filing of such agreements with the committee not more than thirty (30) days after the effective date, require routine review of such agreements filed more than thirty (30) days after the effective date, and provide for ongoing jurisdiction and agency participation; prohibit work on an MOA until filed with the committee, require filing prior to the effective date and proof of necessity, require the committee to maintain records for not less than two (2) years, specify that an MOA shall not be paid until completion of the review process or after disapproval by the committee unless overridden by the secretary of the Finance and Administration Cabinet and the agency head; allow for government emergencies provided a declaration of emergency is filed, and allow the committee to disapprove or object to the rationale for the emergency reviewable only by the governor; allow the committee to receive testimony under oath and establish procedures; allow multiyear contracts and MOA’s that exceed the biennium if funded by federal grant money; redefine certain terms; remove provision exempting agreements between state agencies and state universities or colleges from the definition of MOA; delete exemption for nonfinancial agreements; delete reference to price contracts for personal services; exempt agreements between contracting bodies and artists for less than five thousand dollars ($5,000) from the definition of personal service contract; define proof of necessity; require request for proposals for personal service contracts over $10,000; require the committee to maintain records for not less than two (2) years; specify that personal service contracts shall not be paid until completion of the review process or after disapproval by the committee unless overridden by the secretary of the Finance and Administration Cabinet and the agency head; allow for emergency prepayment provided a declaration of emergency is filed, and allow the committee to disapprove or object to the rationale for the emergency reviewable only by the governor; allow the committee to object to or disapprove contracts and agreements filed with the committee for informational purposes; allow the committee to examine any other issues related to contracts and agreements including the adequacy of the emergency; requirement annual reports of sole source contracts, multiyear contracts, multicontracts, and prequalified master agreements; make conforming amendment to KRS 154A.120; and repeal KRS 45A.023.
