SB 85 (BR 1249) - L. Casebier

     AN ACT relating to the availability of postsecondary textbooks and instructional materials in accessible forms for students with disabilities.
     Create new section of KRS Chapter 164 to require publishers to provide postsecondary instructional materials in an electronic format at no cost to postsecondary institutions for use by students with disabilities; require that the electronic version maintain the structural integrity of the instructional material; set forth procedures for requesting and sending electronic or alternative format instructional materials; permit the Council on Postsecondary Education to establish the State Repository for Alternative Format Instructional Materials, and set forth its duties; permit a postsecondary institution to share alternative format instructional materials it creates with other entities for use by students with disabilities; permit the Council on Postsecondary Education to promulgate administrative regulations, and require it to develop polices and procedures to ensure student access to appropriate instructional materials; require students and institutions to provide certification that electronic and alternative versions of instructional material will be used in a manner in accordance with copyright law; specify that a publisher is a place of public accommodation for the purposes of KRS 344.130, and that failure to comply with this section is subject to action for discrimination on the basis of disability under KRS 344.120; permit the Kentucky Department of Education to share electronic instructional materials with the state repository.

SB 85 - AMENDMENTS


     HFA (1, S. Westrom) - Add a section amending KRS 164.376 to require that the notice of residency assignment for each student shall include a statement as to whether the residence facility is equipped with an operational automatic fire suppression system.

     HFA (2/Title, S. Westrom) - Amend title to read "AN ACT relating to postsecondary education institutions."

     HFA (3, T. Pullin) - Amend KRS 158.070 to provide that when a local school district or school lengthens its school days for students to make up instructional time missed because of weather, illness, or other emergency, the time for certified staff shall be calculated as equivalent time to be applied toward the 175 required instructional days but shall not affect a person's service credit for retirement purposes; if the district uses the flexibility provided under this provision for noncertified personnel, the calculation shall not affect the noncertified person's retirement; EMERGENCY.

     HFA (4/Title, T. Pullin) - Make title amendment.

     HFA (5/P, T. Burch) - Attach the provisions of HB 110 to SB 85.

     HFA (6/Title, T. Burch) - Make title amendment.

     HFA (7/P, T. Burch) - Attach the provisions of HB 77/GA to SB 85/GA.
