     AN ACT relating to drug reimportation and declaring an emergency.
     Create new sections of KRS Chapter 18A, 205.510 to 205.645, and Chapter 211 to establish a drug reimportation program in active and retired state employee and teacher health benefit plans under the Personnel Cabinet, under Medicaid, and under any other program within the jurisdiction of the Cabinet for Health Services or local health departments, that provides for or assists with the purchase of prescription drugs; require the program to consist of a drug formulary and patient safety assurance protections, and require reporting; specify elements for inclusion on formulary and specify safety assurance protections, including the use of a Kentucky pharmacy for the initial fill of a prescription and use of reimportation for cost-effective refills of long-term or maintenance medications, with drugs approved by the FDA in FDA-approved dosages; require the secretaries of personnel and health services to work with the Governor to request the secretary of the United States Department of Health and Human Services to certify to Congress that drug reimportation poses no additional risk, and to request a waiver from the secretary authorizing the drug reimportation program.
