HB 118 (BR 240) - B. Yonts

     AN ACT relating to government contracts.
     Amend various sections of KRS Chapter 45A to provide for redefining the term memorandum of agreement to include federal grant agreements, agreements over $1,000,000, and deletion of all exemptions; redefine the term personal service contract to include contracts for group health care for public employees, agreements over $1,000,000, and deletion of all exemptions; exempt contracts $25,000 and under from Request for Proposals process, but require 3 quotes when feasible; exempt contracts $25,000 and under from the review process, but require filing within 30 days for informational purposes; allow meetings of the committee as necessary, but not less than once per month; require the Governor to override Government Contract Review Committee disapproval or objection to contracts, agreements, and emergency requests and prohibit delegation of decision-making authority by the Governor; and allow the committee to determine exemptions.

HB 118 - AMENDMENTS


     HCS - Retain original provisions except change the term "contracting body" to include cabinet and postsecondary institutions; change the term "memorandum of agreement" to include grant or research agreements, or similar arrangements; require all currently exempt memoranda of agreement, including agreements over $1,000,000.00, agreements for grant or research projects, and any other agreement the committee deems appropriate, to be reported to the committee in a timeframe and in a format as determined by the committee; change the term "personal service contract" to include master agreements for professional services and agreements for the provision of group health care for public employees; require all currently exempt personal service contracts, including transit authorities, agreements between postsecondary institutions and providers of health care services, agreements over $1,000,000.00, and any other agreement the committee deems appropriate, to be reported to the committee in a timeframe and in a format as determined by the committee; require the secretary of the Finance and Administration Cabinet to consider overriding of Government Contract Review Committee disapprovals, objections, and emergency requests, except for postsecondary institutions, and allow university presidents to be responsible for such decisions; prohibit delegation of this decision-making authority.
