HB 205 (BR 127) - J. Wayne, S. Riggs, P. Clark

     AN ACT relating to the rental and occupancy of lots in manufactured home communities.
     Create new sections of KRS Chapter 383 to establish requirements and procedures for good cause eviction of residents of manufactured home communities; establish definitions; prohibit community operators from retaliating against manufactured home residents in certain circumstances; establish requirements for the promulgation of mobile home community rules; establish requirements for community operators that provide utility service to mobile home community residents; require the application of the Uniform Residential Landlord and Tenant Act to residents and community operators of manufactured home communities that lie within a jurisdiction that has adopted the Uniform Residential Landlord and Tenant Act, prohibit certain provisions in rental agreements.

HB 205 - AMENDMENTS


     HFA (1, S. Lee) - Delete existing language of bill and substitute the requirement that all rental agreements between resident and owners of manufactured housing communities be written and resident to be furnished a copy of the signed agreement; establish criteria for rental agreements; establish penalties for failure to honor rental agreement; provide definitions for this Act.

     HFA (2, K. Upchurch) - Delete original provisions of bill; direct the Interim Joint Committee on Local Government to study the issue of tenant-landlord relations in manufactured housing communities; require report to 2006 General Assembly; authorize Legislative Research Commission to direct any other committee to study this issue.

     HFA (3, K. Upchurch) - Amend House Bill 205 to delete operator requirements to deliver written notice of violations to tenant.

     HFA (4, K. Upchurch) - Amend House Bill 205 to remove provisions forbidding landlord refusal to accept rental payments as grounds for eviction.

     HFA (5, K. Upchurch) - Amend House Bill 205 to delete the provision for the showing of good cause for eviction.

     HFA (6, K. Upchurch) - Amend House Bill 205 to delete provisions prohibiting certain acts within a rental agreement.

     HFA (7, K. Upchurch) - Amend House Bill 205 to delete provisions prohibiting landlord retaliation in the event of certain tenant actions.

     HFA (8, J. Wayne) - Modify provision allowing a good cause eviction for resident's failure to make required payments to allow eviction when any amount of rent is delinquent instead of when the amount for delinquent rent equals or exceeds one month's rent; permit a good cause eviction for resident's failure to make required payments to allow eviction when the resident fails to pay the full delinquent amount to clarify that a partial payment will not suffice to prevent eviction; decrease the amount of time required before a community operator may begin eviction proceedings from 30 days to 14 days after written notice was sent to resident; clarify that the community rules must be enforced uniformly by the community operator; decrease the amount of time required before the sheriff or constable shall execute a court order for eviction from 30 to 22 days.
