     AN ACT relating to Internet pharmacies.
     Create a new section of KRS Chapter 315 relating to pharmacies and pharmacists to require internet pharmacies to have a permit to operate in Kentucky and to obey Kentucky pharmacy laws; create new sections of KRS Chapter 315 to specify permitted and prohibited acts for internet pharmacies, how prescriptions for internet pharmacies are to be filled and related matters; create a new section of KRS Chapter 315 to give the Attorney General and Commonwealth's attorneys over felony offenses related to internet pharmacies; create a new section of KRS Chapter 315 to provide for seizure and forfeiture of illegal shipments of drugs; amend KRS 315.010 relating to definitions to conform; amend KRS 315.990 relating to penalties to conform.

     HCS/LM/CI - Delete most original provisions; create a new section of KRS Chapter 315 to set Class C felony penalty for illegal operation of an out of state pharmacy; provide for Class B felony penalty if Schedule I drug caused substantial bodily harm; create a new section of KRS Chapter 315 to exempt common carriers transporting drugs from pharmacy licensing requirements; create a new section of KRS Chapter 315 to give the Attorney General concurrent jurisdiction for investigation and prosecution of violators of the pharmacy laws; create a new section of KRS Chapter 315 to provide a procedure for seizure and forfeiture of illegal drug shipments; amend KRS 315.010 relating to definitions for pharmacy chapter to define as incidental and eliminate from certain regulations pharmacies which fill fewer than 25 prescriptions in a calendar month; amend KRS 315.035 relating to licensing of pharmacies to include pharmacies out of state which operate by the Internet, facsimile, telephone, mail, or otherwise fill prescriptions for Kentucky delivery; require pharmacies who operate solely or primarily through the Internet to meet the qualifications of the National Association of Boards of Pharmacy as a Verified Internet Pharmacy Practice Site; require reporting to Board of Pharmacy; amend KRS 315.0351 relating to out of state pharmacies to include pharmacies out of state which operate by the Internet, facsimile, telephone, mail, or otherwise fill prescriptions in Kentucky and require them to meet the National Association of Boards of Pharmacy Verified Internet Pharmacy Practice Site; require the out of state pharmacy to have a Kentucky licensed pharmacist to ensure compliance with the law; amend KRS 31.990 relating to penalties for violating pharmacy statutes to provide an administrative penalty of not more than $100,000 for operating an illegal out of state pharmacy.
