     AN ACT relating to the provider tax.
     Create a new section of KRS Chapter 142 to require the Cabinet for Health Services to submit a waiver application to the Federal Centers for Medicare and Medicaid Services to exempt state-operated veterans nursing homes from the provider tax; provide that if the waiver is granted veterans nursing homes shall be exempt from the tax beginning on the effective date of the waiver.

     HCS - Delete original provisions; amend KRS 142.301, relating to definitions for the health care provider tax, to exclude state veterans nursing home facilities from the definitions of "nursing-facility services" and "provider"; amend KRS 142.307, relating to the provider tax on nursing-facility services, to exempt state veterans nursing home facilities from the tax; amend KRS 142.361, relating to additional assessments, on gross revenues received by all nursing facility services, to exempt state veterans nursing home facilities from the tax; apply the exemptions retroactively to July 1, 2004.
