HB 430 (BR 1670) - E. Ballard

     AN ACT relating to barbers.
     Amend KRS 317.410 to add definitions for "independent contractor" and "barber pole"; amend KRS 217.420 to require that an independent contractor working in a barber shop hold a barber's license pursuant to KRS Chapter 317; prohibit the use of a barber pole outside a business except to advertise one that provides barbering services and employs at least one licensed barber; amend KRS 317.440 to require the board to promulgate administrative regulations governing materials required for independent contractors; allow the board to refuse to issue a license to an applicant who fails to comply with provisions of KRS Chapter 317 or regulations pursuant thereto; amend KRS 317.450 to update language regarding licensure reciprocity with other states; require licensure applicants to have graduated from high school or passed the GED exam; allow the licensed owner of a barber shop and an unlicensed owner, who has a licensed barber in his employ, to rent or lease space in their shops to an independent contractor; require an independent contractor to pay an annual license fee, in addition to his barber license fee, not to exceed fifty dollars; amend KRS 317.580 to require barbers to observe sanitation and hand washing methods recommended by the Kentucky Cabinet for Health Services before and after contact with each patron; require, after the effective date of this Act, that applicants for a barber shop license have a sink with hot and cold running water located in the room of their facility where barbering services are done; amend KRS 317.590 to prohibit independent contractors from working in a facility that is not licensed under KRS Chapter 317; and amend KRS 317.595 to exempt the holder of a license to operate a barber shop from responsibility for violations committed by an independent contractor.
