AN ACT relating to the provider tax.
Amend KRS 142.301 to add to the definition of "health care items or services," and add definitions for "regional community mental health and mental retardation services", "psychiatric residential treatment facility services," and "supports for community living waiver program"; create new sections of KRS 142.301 to 143.363 to impose a provider tax against regional community mental health and mental retardation services, psychiatric residential treatment facility services, and Medicaid managed care organization services; amend KRS 142.313, 142.317, 142.321, 142.323, 142.327, 142.347, 142.351, 142.353, 142.357, and 205.640 to conform.
HB 461 - AMENDMENTS
HCS - Retain original provisions, except clarify that no Medicaid managed care organization shall be guaranteed repayment, in violation of federal law, of any assessments paid; require the Department for Medicaid Services to use the assessment proceeds to maintain actuarially sound rates as defined in contract with the managed care organization, without creating a guarantee to hold the organization harmless.
SCS - Retain original provisions, except reduce the rate for mental health centers from 5.5% to "up to 4%," and permit a rate "up to 5.5%", rather than 5.5%, for Medicaid managed care organizations and psychiatric residential treatment facilities; make technical corrections.
