     AN ACT relating to taxation.
     Amend KRS 131.010 to define terms; amend KRS 131.130 to include examination of electronic, as well as hard-copy, records by the Cabinet; create a new section of KRS Chapter 131 to indicate when electronic records are acceptable and when they may be required; establish standards for records and filing; create a new section of KRS 160.613 to 160.617 to require electronic filing and paying of utility gross receipts license taxes; amend KRS 131.190 to permit the Revenue Cabinet to share utility gross receipts license tax information with school districts.

HB 497 - AMENDMENTS


     SCA (1, D. Kelly) - Amend KRS 138.510 to exempt a one-day international horse racing event from pari-mutuel tax; EFFECTIVE JANUARY 1, 2006.

     SCA (2, D. Kelly) - Amend KRS 139.536 to allow an approved company a refund of the lesser of the sales tax liability or 50% of the approved costs if the tourism attraction includes a facility including, but not limited to, a lodging facility located on recreational property owned or leased by the Commonwealth or federal government.

     SFA (1, R. Palmer II) - Amend KRS 139.470 to exempt the first $50,000 in sales of admissions to county fairs.

     SFA (2, R. Palmer II) - Exempt county fair admissions from sales and use tax if the county fair is held by a nonprofit county fair board in counties with a population of less than 30,000.

     CCR - Cannot agree.

     FCCR - Retain the provisions of HB 497/GA with the following changes: amend 2005 HB 267/EN to provide language regarding interlocal agreements between the Transportation Cabinet and local governmental units, to clarify authorization for the UK Bed Tower Project, to revise language relating to enterprise zone initiatives, to amend the funding source for a Morehead dorm renovation project, to amend provisions relating to the equalized facility funding program to allow funding to continue for twenty years rather than ten years, and to provide that the tobacco research trust fund shall receive at least $3,140,000 regardless of whether the half cent cigarette tax levy produces that amount; amend Section 9 of 2005 SB 23/EN to delete the word "who" and insert the word "that"; amend KRS 139.536, 148.851 and 148.859 to provide enhanced tourism development credits for facilities located on a state or national park; amend KRS 139.470 to exempt the first $50,000 in county fair admissions from the sales and use tax; provide that provisions included in reorganization bills changing names and titles shall not prevail over other amendments to the same statute section in other bills enacted during this session; make title amendment; EMERGENCY.
