HB 59 (BR 292) - M. Weaver, J. Draud, C. Miller
AN ACT relating to public agencies and declaring an emergency.
Amend KRS 61.810 to create an Open Meetings Law exception for the discussion of certain homeland security records; amend KRS 61.878 to create an Open Records Law exception for certain homeland security records; amend KRS 313.130, 319.082, 327.070, and 342.347 to conform; EMERGENCY.
HB 59 - AMENDMENTS
HFA (1, M. Weaver) - Add an exception to the Open Records Law for a record when the disclosure of that record will expose a homeland security vulnerability and that record describes the exact physical location of hazardous chemical, radiological, or biological materials.
HFA (2, J. Wayne) - Permit a public agency to deny inspection of a homeland security public record only for a reason identified in the Act; require that a public agency provide the Attorney General with a copy of a written denial of a request to inspect a homeland security public record; require that the homeland security exception to the Open Records Law shall not affect the obligations of a public agency with respect to disclosure and availability of public records under state environmental, health, and safety programs.
HFA (3, T. Riner) - Permit a member of the Kentucky General Assembly to attend that portion of any public agency meeting closed for a discussion of a homeland security record.
HFA (4, T. Riner) - Permit a member of the Kentucky General Assembly to inspect a homeland security record otherwise exempt from disclosure.
SCS - Retain provisions of the bill; add an Open Records Law exception for certain historic, literary, artistic, and commemorative items accepted by the archivist of a public university, museum, or government depository; limit the exception to the extent that the donor requests nondisclosure; permit an official public custodian to certify a copy of a record.
