SB 136 (BR 149) - D. Kelly

     AN ACT relating to the Office of the Governor.
     Amend KRS 12.023 to establish the organizational structure of the Office of the Governor, transferring some agencies, renaming others; amend KRS 147A.002 to change the name of the Department for Local Government to the Governor's Office for Local Development (GOLD); establish the organizational structure of the GOLD, including the establishment of the Division of Grants, Division of Financial Management and Administration, Office for Legislative Services, Office of Local Initiatives for a New Kentucky, Renaissance Kentucky Office, and Kentucky Community Development Office, and the duties of each; amend KRS 147A.003 to attach to GOLD, for administrative purposes, the Kentucky Infrastructure Authority, East Kentucky Corporation, and West Kentucky Corporation; abolish the Kentucky Appalachian Commission, the Local Government Advisory Commission, Appalachian Development Council, State-Federal Council for Balance Economic Growth, Division of Flood Control, Water Resource Development Commission, and Flood Control Advisory Commission; amend KRS 42.4588 to direct that the Governor’s Office for Local Development administer the single county Local Government Economic Development Fund; expand grant eligibility for single county LGEDF projects; amend various KRS sections to conform; repeal KRS 11.180 (Kentucky Appalachian Commission), KRS 11.182 (Membership), KRS 11.184 (Officers, Duties), KRS 147A.006 (Local Government Advisory Commission, KRS 147A.009 (Division of Flood Control), 147A.011 (Water Resource Development Commission), 151.560 (Flood Control Advisory Commission), 151.570 (Duties of Commission), and 154.33-020; provide directions to the reviser of statutes; confirm Governor's Reorganization Executive Order 2004-727, relating to the transfer of the administration of the single county coal fund to the Governor's Office for Local Development; confirm the portions of the Governor's Executive Order 2004-728, dated July 9, 2004, relating to the organization of the Office of the Governor, the renaming of the Department for Local Government, and the reorganization of the Governor's Office for Local Development, to the extent each order is not otherwise confirmed or superseded by this Act.

     SFA (1, D. Kelly) - Make technical correction.

     HFA (1, J. Barrows) - Delete the provision that expanded grant eligibility for single county Local Government Economic Development Fund projects; restrict award of grants by the commissioner of the Governor's Office for Local Development pursuant to executive branch budget appropriations.

     HFA (2, J. Barrows) - Delete the provision that expanded grant eligibility for single county Local Government Economic Development Fund projects; restrict award of grants to a particular county by the commissioner of the Governor's Office for Local Development pursuant to executive branch budget appropriations for that particular county.
