AN ACT relating to prescription drugs.
Create a new section of KRS 205.510 to 205.645, relating to Medicaid, to define "claims processing," "other prescription drug or drug services," and "pharmacy benefit manager"; prohibit the Cabinet for Health Services from entering into a contract with a pharmacy benefit manager unless the pharmacy benefit manager is not owned, in whole or in part, by a drug company and agrees to disclose ownership of five percent or more in a pharmacy, to pass along cost savings negotiated with a pharmacy to Medicaid, not to discriminate against a pharmacy in favor of another pharmacy in which the company has an ownership interest of five percent or more, to make public annually the percentage of rebates received that is passed back to Medicaid, to annually provide financial and utilization information, and to annually provide financial terms for remuneration between the pharmacy benefit manager and any drug company; provide that any contract be voidable if the pharmacy benefit manager fails to comply with these requirements; create a new section of KRS Chapter 18A, relating to the state employee health insurance program, to define "claims processing," "other prescription drug or drug services," and "pharmacy benefit manager"; prohibit the Finance and Administration Cabinet from entering into a contract with a pharmacy benefit manager unless the pharmacy benefit manager is not owned in whole or in part by a drug company and agrees to disclose ownership of five percent or more in a pharmacy, to pass along cost savings negotiated with a pharmacy to the state employee health insurance program, not to discriminate against a pharmacy in favor of another pharmacy in which the company has an ownership interest of five percent or more, to make public annually the percent of rebates received that is passed back to state employee health insurance program, to annually provide financial and utilization information, and to annually provide financial terms for remuneration between the pharmacy benefit manager and any drug company; and provide that any contract be voidable if the pharmacy benefit manager fails to comply with these requirements.
