     AN ACT relating to health information and declaring an emergency.
     Create various sections of KRS 216 to define terms, create the Kentucky Health Care Infrastructure Authority jointly by the University of Kentucky and the University of Louisville; identify responsibilities of the authority which include conducting research on health information electronic applications, conducting pilot projects, and serving as a forum for the exchange of ideas and consensus building related to the advancement of the health information infrastructure and health care applications; permit the authority to seek federal and private funding; require an annual report to the Governor, secretary of the Cabinet for Health Services, Legislative Research Commission, Interim Joint Committee on Health and Welfare, and Interim Joint Committee on Banking and Insurance; create the Kentucky e-Health Network Board to oversee the development, implementation, and operation of a statewide electronic health network of voluntary participants using federal and voluntarily contributed funds; attach the network to the Cabinet for Health Services for administrative purposes; establish the membership of the board and various committees; require the board to appoint an advisory group to ensure input into implementation of the network; authorize the Governor to restructure the Telehealth Board under the Cabinet for Health Services and to restructure the Telehealth Board as a Telehealth Committee of the Ke-HN Board subject to confirmation of the Kentucky General Assembly under KRS 12.028; require the board to consider various models, including a model with the capability to integrate with an electronic Medicaid management information system and public health alert features; require the board to submit the model to be implemented to the Legislative Research Commission; require any transactions to comply with the federal Health Insurance Portability and Accountability Act; require the board to oversee the development of the network of providers and payors and adopt standards for computer systems communicating with the network; require that geographical locations that are critical to homeland security and protection of energy production be given priority in phasing in the network; authorize the board to promulgate administrative regulations; require an annual report to the Governor, Cabinet for Health Services, Office for the New Economy, Interim Joint Committee on Health and Welfare, and the Interim Joint Committee on Banking and Insurance; establish a "Ke-HN fund"; amend KRS 45A.605 to permit the network to use the "information highway" for transactions, but not limit the network to the use of the highway to implement its communications; and delay the appointment of board members until funds are available for administrative costs of the board; EMERGENCY.

SB 2 - AMENDMENTS


     SCS - Retain original provisions, except include optometrists in the definition of "health care provider"; permit the Governor to appoint an insurance representative to the Kentucky e-Health Board who is recommended by the Kentucky Association of Health Plans or an employee of a company which has its headquarters located in Kentucky; and make technical corrections.

     HFA (1, T. Thompson) - Retain original provisions; create a new section of subtitle 17A of KRS Chapter 304 to require any insurer issuing or delivering group health benefit plans in the Commonwealth to provide an employer-organized association health benefit plan with information relating to its health benefit plan that has been requested, including aggregate claims experience data, total premiums paid, total number of insureds, and details to permit the association to verify eligibility and participation of the groups and individuals participating in the employer-organized association program; require the Department of Insurance to promulgate administrative regulations to implement this section by July 15, 2005; and permit the insurer to provide nonpublic personal health information to the employer-organized association health benefit plan as a covered entity to cover entity transfer under the federal Health Insurance Portability and Accountability Act of 1996 if the health benefit plan certifies that it will treat the information in accordance with HIPAA.
