AN ACT relating to the licensure of prescription drug wholesalers.
Amend KRS.036 to require licensure of wholesale distributors of prescription drugs; amend KRS 315.010 to define terms; create various new sections of KRS Chapter 315 to specify licensure requirements for wholesale distributors of prescription drugs; require a criminal background check for an applicant for licensure; require wholesale distributors to complete continuing education and pass a test on federal and state laws regarding the wholesale distribution of prescription drugs; establish requirements for representatives of wholesale distributors; require wholesale distributors applying for licensure to submit a bond of at least $100,000 or other equivalent security; permit wholesale distributors to receive prescription drugs from a pharmacy under an agreement between the parties; prohibit the sale of drugs to parties other than those licensed to receive the drugs; require prescription drugs to be delivered only to the premises listed on the license, except in certain circumstances; permit prescription drugs to be delivered to a hospital; require the maintenance of records and tracking of all transactions; require electronic tracking of prescription drug distribution on December 31, 2007; establish requirements for the drug pedigree; permit the Board of Pharmacy to promulgate administrative regulations to carry out these requirements; establish violations; and amend KRS 315.990 to establish penalties of 15 years in prison or a $50,000 fine or both for certain violations and increase the penalty to any number of years in prison or a $500,000 fine or both for knowingly committing certain violations.
