SB 218 (BR 1317) - C. Borders

     AN ACT relating to medical assistance.
     Amend KRS 205.640 to redirect distribution of disproportionate share funds to cover unreimbursed indigent care costs of nonstate publicly owned hospitals, allow for unreimbursed indigent care costs of state-owned university hospitals to be covered based upon transfer of the state share of payments from the hospitals to the Cabinet for Health Services, and allow for funds to private acute care hospitals to be based on the availability of state matching funds; provide for payments to be made annually to private acute state-owned university and private and public psychiatric hospitals, and quarterly to nonstate public acute hospitals; delete requirement that payments to state mental hospitals, university hospitals, acute care hospitals, and private psychiatric hospitals be equal to the maximum amount of disproportionate share payments established under the Federal Balanced Budget Act of 1997.

SB 218 - AMENDMENTS


     SCS - Retain original provisions, except amend KRS 205.640 to retain the existing distribution percentage of disproportionate share funds for acute care hospitals and university hospitals.

     HCS - Retain original provisions; establish effective date contingent upon certification, no later than July 1, 2006, to the Reviser of Statutes from the secretary of the Cabinet for Health Services that necessary federal approval of the proposed distribution of disproportionate share funds has been obtained.

     HFA (1, T. Burch) - Amend KRS 205.640 to restore original language requiring total annual disproportionate share payments to be equal to the maximum amount established under federal law, subject to the availability of adequate state matching funds and not exceeding uncompensated costs.
