SB 220 (BR 1505) - D. Williams
AN ACT relating to drug testing of teachers.
Create a new section of KRS Chapter 161 to require a teacher to submit to random drug testing for a period not to exceed 12 months if the teacher has been reprimanded, disciplined, or had his or her certification suspended or revoked as a result of illegal use of controlled substances.
SB 220 - AMENDMENTS
SCS - Retain original provisions except to clarify that drug testing of a teacher shall only be done after an administrative or judicial proceeding; provide that the Education and Professional Standards Board, rather than the Ky. Board of Education, will promulgate administrative regulations relating to drug testing; delete maximum 12 month duration of drug testing when a certificate has been revoked or suspended; clarify that Education Professional Standards Board may require other conditions for reissuance or reinstatement of certificate; define "teacher" as any person for whom certification is required for employment in the public schools of the commonwealth.
