SB 57 (BR 400) - T. Jensen
AN ACT relating to eggs.
Amend KRS 260.540 to define "egg distributor" and "withdraw from sale order"; amend KRS 260.550 to establish the conditions under which a license can be withdrawn; amend KRS 260.570 to establish meeting requirements for the Egg Marketing Board; amend KRS 260.600 to clarify parameters under which a license will be renewed; increase various egg handling fees; specify at what point fees are to be paid; amend KRS 260.640 to establish reasons to issue a withdraw from sale order; amend KRS 260.990 to set forth the penalty that will be assessed for violating a withdraw from sale order.
SB 57 - AMENDMENTS
SCS - Retain original provisions of SB 57; amend definition of "withdraw from sale order" to permanently remove eggs from retail sale; define "stop order"; authorize inspectors of the Department of Agriculture to issue a stop order to a person selling shell eggs or egg products if the person does not have a license, has not paid fines owed to the department, or has improperly labeled the eggs; authorize inspectors from the Department of Agriculture to issue a withdraw from sale order if the eggs are above 45 degree Fahrenheit for four hours or more or are unfit for human consumption; establish penalties for a person violating a stop order and for a person violating a withdraw from sale order.
