AN ACT relating to disability insurance.
Create new sections of Subtitle 14 of KRS Chapter 304 to provide for utilization review of disability plans; require each disability insurer to have an internal review process; authorize the covered person to initiate the internal appeals process; establish minimum requirements for the process; require each insurer to have an external review process; permit a covered person to request an external review of a denial of a claim; authorize a one-time filing fee of twenty-five dollars ($25) payable by the covered person to the independent review entity; require insurers to use independent review entities on a rotating basis; provide that the external review shall be confidential; require the external reviews to be conducted and a determination made with twenty-one (21) calendar days of receipt of all information required from the insurer; specify the information the independent review entity must take into consideration; require the independent review entity to disclose its decision to the covered person, treating provider, insurer, and the office of insurance; provide penalties for an insurer that fails to provide coverage required by the independent review entity; require a person with new clinical information regarding the covered person's internal appeal to provide that information to the insurer prior to initiation of the external review process; authorize the executive director of the office of insurance to promulgate administrative regulations; amend KRS 304.17A-603 to conform.
HB 143 - AMENDMENTS
HCS - Retain original provisions; change "61.884" to "61.882" in subsection (9) of Section 3; make technical change in subsection (5) of Section 4 and delete provision that the independent review entity's decision is presumed to be a scientifically valid and accurate description of the state of medical knowledge at the time it was written; delete subsection (9) of Section 4.
HFA (1, J. Gooch Jr) - Amend the definition of "disability plan" to include insurance to provide for indemnity for payments becoming due on a specific loan or other credit transaction.
