HB 151 (BR 468) - J. Higdon, R. Mobley, T. Riner

     AN ACT relating to indoor tanning devices.
     Create new sections of KRS Chapter 217 to define terms related to indoor tanning, prohibit children under the age of 14 from using tanning devices; prohibit minors between 14 and 18 years of age from using a tanning device without written parental consent; require parent or guardian to sign a form permitting the use of tanning devices by a minor and limiting the maximum number of times for use in a 30 day period; require a warning statement pursuant to 21 CFR 1040.20 to be posted in tanning facilities; require tanning facilities to keep parental consent forms for a period of not less than two years and register with the local department of health with a fee of $20 dollars; require the Cabinet for Health and Family Services to promulgate administrative regulations to implement the provisions of this Act and create penalties for violation; and require inspections by representatives of the Cabinet for Health and Family Services or the local health department twice each year and as needed; require administrative hearings to be conducted in accordance with KRS Chapter 13B.

     HCS - Amend original bill to require persons between 14 and 17 years of age to present a written or electronic statement from a parent or guardian that indicates that they have read and understand the warnings given, that they permit the use of tanning devices, and that they agree the minor will use protective eyewear; require the permission statement to be valid for one year; require a person under the age of 14 years to be accompanied by a parent or legal guardian when using a tanning device; delete limits on the maximum number of times for use in a 30-day period; delete requirement for inspections by representatives of the Cabinet for Health and Family Services or the local health department twice each year and as needed; retain other provisions.
