     AN ACT relating to noise-sensitive areas surrounding public use airports.
     Amend KRS 183.011 to define the terms "noise compatibility program," "noise exposure map", "noise-sensitive area," "noncompatible land use," "noise compatibility permit," and "review agency"; create a new section of KRS Chapter 183 to require all airports that have adopted a noise exposure map to file a copy of such a map with the review agency and the Airport Zoning Commission; require the issuance of a noise compatibility permit prior to construction, modification, or alteration of any land or structure within a noise sensitive area; require the reviewing agency to use standards set forth in issuing a noise compatibility permit; grant the Airport Zoning Commission the authority to promulgate administrative regulations regarding application procedures for permits under its jurisdiction; create a new section of KRS Chapter 183 to establish notification procedures for permit applications; establish the right of the airport in question to comment to the review agency on the advisability of issuing the permit; require recording of the permit with the county clerk's office; establish requirements as to the form and wording of a noise compatibility permit issued for a noncompatible land use, including releasing the airport operator from liability for noise-related damage; create a new section of KRS Chapter 183 to differentiate between permits issued for compatible and noncompatible land use; create a new Section of KRS Chapter 324, regarding real estate sales, to establish disclosure requirements on property on which a noise compatibility permit has been issued.
