HB 23 (BR 49) - S. Riggs
AN ACT relating to management districts.
Amend KRS 91.756 to require the ordinance that establishes a management district to contain a requirement that a copy of the district's annual budget and economic improvement plan is submitted to the local legislative body which created the district, and delete language which would require approval by the local legislative body of the annual budget and economic improvement plan, and the establishment and schedule for such approval; amend KRS 91.758 to delete language which required submission and approval of the annual budget and economic improvement plan by the local legislative body and in lieu of that process require the board to publish both the annual budget and economic improvement plan; amend KRS 91.760 to require all board of directors members to be property owners, representatives of property owners, or tenants within the district with the exception of ex-officio members; require 2/3 of the total number of board members to be property owners within the district or their representatives in lieu of requiring only a simple majority of the board to be property owners or their representatives; and amend KRS 91.762 to require a petition signed by a number of property owners equaling at least 50.1% instead of 75% of the assessed property value in the district and 33% of the total number of property owners in the district prior to the dissolution of a management district.
HB 23 - AMENDMENTS
HCA (1, S. Riggs) - Amend original language to require local government approval of the annual budget of a management district; limit the total debt capacity that may be carried by a management district to $500,000.
