HB 258/LM (BR 388) - M. Denham

     AN ACT relating to the evacuation and relocation of prisoners in jails and regional jails.
     Create a new section of KRS Chapter 441 to require jailers, in conjunction with the Department of Corrections, to prepare evacuation and relocation procedures for jails in the event of an emergency that renders the jail uninhabitable either temporarily or permanently.

     SCS/LM - Retain original provisions of bill; allow Department of Corrections to specify any penalty for noncompliance with provisions of bill; expand timeline of creation of administrative regulations to 180 days, from 120 after the effective date of the Act; specify that the jailers have until January 31, 2008, to complete their plans; allow the department to delegate the responsibility of developing the evacuation and relocation protocol to the Jail Standards Commission; allow the department to consult and collaborate with the commission on any aspect of the requirements of the Act.
