AN ACT relating to workers' compensation and declaring an emergency.
Amend KRS 342.122 to require the Workers' Compensation Funding Commission, by June 30, to establish a special fund assessment rate, and on or before October 1 of each year to notify all insurance carriers writing workers' compensation insurance in the state, including group and individual self-insured employers, of rates to become effective January 1 of each year unless rates are modified by the General Assembly; amend KRS 342.1242, beginning 2006, to change the date that the funding commission determines the assets of the coal workers' pneumoconiosis fund and sets assessment rates, from September 1 to June 30, and require notice of rates changes be given no later than October 1 instead of December 1 of the year preceding the rate change; amend KRS 342.1224 to change the membership of the funding commission to include the secretary of the Environmental and Public Protection Cabinet, or designee, instead of the commissioner of the Department of Labor.

SFA (1, D. Thayer) - Retain original provisions of this Act; require an employer's liability for medical services in a workers' compensation claim to cease when the claimant becomes eligible for federal Medicare benefits or reaches age 65, whichever occurs later.
