HB 472 (BR 1766) - G. Lindsay

     AN ACT clarifying that state lottery prizes paid in installments over time may be assigned under certain circumstances.
     Amend KRS 154A.110, relating to lottery prizes, to permit their assignment with Circuit Court approval under certain circumstances.

HB 472 - AMENDMENTS


     HCS - Specify that any person contracted to receive prize payments in installments over time by the corporation, excluding prizes payable for the winner's life, from being eligible for assignment; increase the reasonable fee from five hundred to one thousand dollars; remove the language stating that upon receipt of a ruling from the IRS or a court decision that the President of the Kentucky Lottery Corporation file a copy of the order with the Secretary of State, and the clerks of the House of Representatives and Senate.

     HFA (1, G. Lindsay) - Permit assignment pursuant to an order of the Circuit Court located in the judicial court where the corporation headquarters are located; specify the contents of the order; require, as a condition of assignment, the assignor to disclose the existence or non-existence of a current spouse and, if married, to submit notarized statement that spouse consents to the assignment; prohibit an assignment from including payments that are subject to offset or withholding due to delinquent child support obligation, a debt owed to a state agency; or any attachments, garnishments, or executions authorized by statute and served upon the process agent of the corporation; prohibit division of any single prize payment among more than three different persons or entities; require the assignor or the assignee to be responsible for providing the corporation information necessary for identifying the parties to any assignment and making the assigned payments.
