AN ACT relating to prescriptive authority for advanced registered nurse practitioners.
     Amend KRS 314.011 to permit advanced registered nurse practitioners to prescribe, but not dispense, controlled substances; establish conditions for prescribing each schedule of controlled substances; authorize advanced registered nurse practitioners to prescribe a 72-hour supply of Schedule II controlled substances, except that an advanced registered nurse practitioner certified in psychiatric-mental health nursing who is providing services in a health facility as defined in KRS Chapter 216B or in a regional mental health-mental retardation services program may prescribe a 30-day supply of psychostimulants; authorize advanced registered nurse practitioners to prescribe a 30-day supply of Schedule III controlled substances without any refill; authorize advanced registered nurse practitioners to prescribe Schedule IV and V controlled substances and refills up to a six months supply; establish the Controlled Substances Formulary Development Committee to advise the Kentucky Board of Nursing regarding the promulgation of administrative regulations to limit advance registered nurse practitioner prescribing specific controlled substances; amend KRS 314.042 to require a written collaborative agreement between the advanced registered nurse practitioner and the collaborating physician defining the scope of the prescribing authority for controlled substances; require the advanced registered nurse to inform the Board of Nursing of the existence of the agreement and the name of the collaborating physician; require the Board of Nursing to provide the Board of Medical Licensure with the name of the collaborating physician; require the prescribing advanced registered nurse practitioner and the collaborating physician to have the same or similar specialty qualifications; require registration as an advanced registered nurse practitioner for one year prior to prescribing controlled substances; require advanced registered nurse practitioners to obtain certification from the U. S. Drug Enforcement Agency; amend KRS 314.195 to conform; amend KRS 218A.010 to include advanced registered nurse practitioner in the definition of "practitioner"; amend KRS 218A.202 to permit the Cabinet for Health and Family Services to provide data to the Board of Nursing concerning nurse practitioners who are associated with a physician or nurse practitioner who is under investigation for improper prescribing practices or who are in a geographical area where there is either a trend report or report on a nurse practitioner or physician which indicates a substantial likelihood that inappropriate prescribing may be occurring.
