     AN ACT relating to the encouragement of investment in clean coal energy generation.
     Create a new section of KRS Chapter 278 to provide for policy to encourage clean coal generation; define clean coal generation; provide that a utility be entitled to recovery of costs for investing in clean coal generation; provide for procedures and establishment of a surcharge to customers in order to obtain reasonable return on expenditures relating to clean coal investment costs; provide for application and hearing procedures for establishing costs and surcharge amounts; provide for period review of surcharges and for adjustments and refunds if warranted; provide that commission retain jurisdiction to review surcharges.
