     AN ACT relating to smoking.
     Amend KRS 61.165 to require a smoking policy to be adopted by state government; permit smoking policies in local government office buildings or workplaces; permit those policies to restrict indoor smoking.

HB 55 - AMENDMENTS


     HFA (1, S. Nunn) - Retain original provisions of the bill; amend to permit consolidated local governments to adopt smoking policies for local government office buildings or workplaces.

     HFA (2, T. Riner) - Delete the smoking policy exemption for jails and detention facilities.

     HFA (3, T. Riner) - Delete the exemption for state universities, state-operated hospitals, state-operated health facilities, and jails.

     SCS - Retain the original provisions of the bill; mandate a written smoking policy be adopted in state government buildings or specifically prohibit smoking in the building; provide guidelines for compliance; provide local control regarding smoking policies in buildings owned and controlled by local governments; provide that the board of regents or trustees be responsible for adopting a written smoking policy regarding buildings owned, operated, or under the control of postsecondary education institutions.

     SFA (1, J. Denton) - Amend KRS 131.130 to define distributor as a person who distributes only cigarettes and purchases 100 percent of them from a single manufacturer with whom the person has an exclusive relationship to serve a defined geographical territory; amend KRS 131.195 to require a distributor to obtain a license; permit the distributor to sell or purchase from any other licensee untax-paid cigarettes; require the distributor to secure a separate license for each place of business where the untax-paid cigarettes are received; require the distributor to maintain records in accordance with administrative regulations promulgated by the department.
