     AN ACT relating to organ and tissue donation.
     Create a new section of KRS Chapter 194A to require the cabinet to establish and maintain a statewide registry for organ and tissue donation; permit funding by state, federal and private funds; permit gatekeeper functions to be performed by public or private entity; require collaboration among affected agencies and facilities; require the cabinet to specify access to the registry; require the cabinet to evaluate the effectiveness of the operation of the registry; permit the cabinet to promulgate administrative regulations for the operation of the registry.

HB 57 - AMENDMENTS


     HCS - Specify that contingent upon available funding, the cabinet shall facilitate the establishment of a statewide electronic organ and tissue donor registry and permit contracting to a public or private nonprofit entity to perform gatekeeper functions of operation, maintenance, privacy, and security of the registry; require an ongoing collaboration among Transportation Cabinet, Cabinet for Health and Family Services, Circuit Court Clerks Trust for Life, Kentucky Hospital Association, and Kentucky Cancer Caucus, and organ procurement organizations to develop strategies for operation of the registry; specify strategies include donor registration by driver's license and on-line registration, removal from registry, access to registry, and evaluation; permit Cabinet for Health and Family Services to promulgate administrative regulations.

     HFA (1, S. Nunn) - Retain original provisions; specify the registry is for transplantation purposes; delete the Kentucky Cancer Caucus from the collaborative.

     HFA (2, S. Nunn) - Retain original provisions and add the Kentucky Medical Association to the collaboration.
