HB 582 (BR 1482) - R. Crimm

     AN ACT relating to operation or use of a motor vehicle.
     Create a new section of KRS Chapter 411 to prohibit a person from recovering noneconomic losses as a result of operation of a motor vehicle if the injured person was uninsured, or was operating the vehicle in violation of KRS 189A.010, 189A.105, or 189A.090, or was committing a felony or in immediate flight therefrom; provide that an insurer is not liable for noneconomic damages for such an injured person under a motor vehicle liability policy, uninsured motorist, or underinsured motorist insurance; allow an insurer to withhold paying a claim to such an injured person until final judgment of guilt or innocence.
