AN ACT relating to damages.
Create a new section of KRS Chapter 189 to establish that physical contact is not required to recover damages in personal injury or wrongful death claims arising from vehicle accidents where competent proof shows by a preponderance of evidence that the negligence or other actionable misconduct of the defendant, or unknown defendant in an uninsured vehicle or underinsured motorist coverage claim, was a substantial factor; amend KRS 304.20-020 and 304.39-320 to conform.
