HB 677/LM (BR 1457) - M. Harmon

     AN ACT relating to the certification of court security officers.
     Create new sections of KRS 15.380 to 15.404 to provide for the qualifications of a certified court security officer and provide for grandfathering provisions; provide for the revocation of status for a court security officer; set out training requirements for a court security officer; establish certification categories for certified court security officers; provide that the position of certified court security officer is not eligible for hazardous duty and that those officers are not eligible for Kentucky law enforcement foundation program funds without meeting the requirements of KRS 15.382, 15.404, and 15.440; amend KRS 15.310 to integrate the position of court security officer with the basic training course provided by the Department of Criminal Justice Training and redefine "basic training course" and define "certified court security officer"; amend KRS 15.380 to require court security officers to be certified by the Department of Criminal Justice Training; amend KRS 15.388 to include court security officers within the requirements of reporting to the law enforcement council their certification status and provide that if a certified court security officer has successfully completed the basic training required by the Act and transfers to another employer, that both employers have 10 working days to report the fact to the law enforcement council for the officer to maintain status; prohibit a certified court security officer from transferring to a peace officer position unless the certified court security officer meets the requirements for being a certified peace officer, and provide that if the officer does, according to the provisions of this section, transfer, then the employers have 10 working days to notify the council for the officer to maintain status; create a new section of KRS Chapter 70 to establish the duties of a certified court security officer, and establish what functions a court security officer shall not perform; amend KRS 23A.090 and 70.030 to allow sheriffs to appoint certified court security officers and revoke the appointment at pleasure; require officer to take an oath; prohibit certified court security officers only certified under the status of a court security officer to participate in Kentucky Law Enforcement Foundation Program fund; amend KRS 70.036 to allow certified court security officers to wear official uniform and allow the expenses of uniforms to be paid by the fiscal court; amend KRS 70.140 to allow certified court security officers to represent the sheriff at the meetings of the fiscal court and courts of justice; amend KRS 527.020 to allow certified court security officers to carry concealed weapons when on duty.
