AN ACT relating to the importation of prescription drugs.
Create various new sections of KRS Chapter 217 to declare findings related to the I-SaveRx program that allows Illinois residents to refill prescriptions for the most common brand-name prescription drugs used to treat chronic illnesses from a network of inspected and approved pharmacies in Canada and the United Kingdom through a Web site; require the Cabinet for Health and Family Services to enter into a memorandum of agreement to join the I-SaveRx program; establish required provisions of the memorandum of agreement; appoint the secretary of the Cabinet for Health and Family Services and the president of the Kentucky Board of Pharmacy as members of a joint work group charged with providing input regarding the safe and effective administration of the I-SaveRx program; permit Kentucky or Illinois to withdraw from the cooperative relationship at any time; require the signature of the Governor of Kentucky or action of the Kentucky General Assembly to withdraw Kentucky from the memorandum of agreement with the I-SaveRx program; require the memorandum of agreement to be signed by the Governor of Kentucky prior to implementation; create a working group to develop outreach and promotional materials; provide the Commonwealth of Kentucky with immunity from liability for any injury or damage caused to a person from products obtained through the I-SaveRx program; and amend KRS 315.035 and KRS 315.0351 to exempt pharmacies providing prescription drugs through the I-SaveRx program from the requirement that all pharmacies that operate by means of the Internet have a permit to operate in Kentucky.
