AN ACT relating to stockyards.
Create a new section of KRS 261 to require stockyards and buying stations to carry certain insurance coverage; amend KRS 261.200 to change definition of "stockyard" and "livestock," and add definition of "market agency," "livestock dealer," and "farmer"; amend KRS 261.210 to specify that the department shall administer and enforce the chapter by regulation; amend KRS 261.230 to allow the department to establish stockyard license fees by regulation; amend KRS 261.260 to establish bonding requirements for a stockyard, market agency, and livestock dealer; amend KRS 261.270 to establish stockyard scale certification; allow the department to establish weighman bonding requirements by regulation; amend KRS 261.290 to specify licensing powers of the board; amend KRS 261.320 to specify qualifications of stockyard veterinarians; amend KRS 261.352; establish payment procedures for livestock purchased at auction; amend KRS 261.900 relating to fines for violations of the chapter and KRS 257.990 to conform; repeal, reenact, and amend KRS 257.520 to add exceptions related to future farmers, 4-H, fair, and association sales; repeal, reenact, and amend KRS 257.530 to establish livestock dealer license fees by regulation; specify dealer license requirements; repeal, reenact, and amend KRS 257.540 to establish regulatory powers for livestock dealers; repeal KRS 257.510.
HB 738 - AMENDMENTS
HCS - Retain original provisions except, in Section 1 delete Department of Agriculture's regulatory responsibilities for stockyard and buying station insurance; restore current statutory stockyard licensing amounts; require licenses to comply with KRS 261 and KRS 257, and the U.S. Packers and Stockyards Act; restore current potential fines and jail time for violations; restore the current license fee for livestock dealers; repeal KRS 261.290 because the language is incorporated elsewhere in the bill.
