AN ACT relating to health care.
Create a new section of KRS 205.510 to 205.645 to create the Fair Share Health Care Fund within the Cabinet for Health and Family Services for the purpose of supporting the operations of the Medicaid program; permit the fund to receive funds; create new sections of KRS Chapter 336 to define "commissioner," "employee," "employer," "health insurance costs," and "wages"; provide that the term "employer" does not include a nonprofit entity or governmental agency, but that it includes only companies with 10,000 or more employees; provide that an employer, on January 1, 2007, and annually thereafter, shall submit to the commissioner of the Department of Labor the number of employees in Kentucky as of January 1 of the previous year, the amount spent by the employer during that previous year on health insurance costs in the state, and the percentage of payroll that was spent by the employer in the previous year on health insurance costs in the state; require an employer that does not spend 8% of the total wages paid to employees in the state on health insurance costs to pay to the commissioner an amount equal to the difference between what the employer pays up to 8% of the total wages paid to its employees in the state; assess a $250 civil penalty for each day that the report is not made, and a $250,000 civil penalty for failure to make the required payment; require the commissioner to report by March 15 each year to the Governor on various aspects of the program; require the commissioner to verify each year the number of employers in Kentucky with 10,000 or more employees; require the commissioner to promulgate an administrative regulation to carry out the provisions of the bill; identify the Act as the "Fair Share Health Care Act"; EFFECTIVE JANUARY 1, 2007.
